WNR'S Circle Training Facility: Terms of Service

1. Who we are

These Terms of Service ("Terms") are an agreement between you and Winners Circle Training Facility, doing business as WNR'S Circle Training Facility ("WNR'S," "we," "us" or "our"), located at 3000 Empire Ave, Burbank, CA 91504.

These Terms cover your use of our website at wnrscirclegym.com, our check in and sign up pages at join.wnrscirclegym.com, our online forms, and the text messages and emails we send (together, the "Services").

2. Accepting these Terms

By using the Services, submitting a form, or opting in to our messages, you agree to these Terms. If you do not agree, please do not use the Services. You must be at least 18 years old to use the Services, or have a parent or guardian agree to these Terms for you.

3. Memberships, day passes and the waiver

• These Terms cover the website, forms and messages. Training at the gym is covered by our Facility Waiver, Release of Liability and Member Agreement ("Member Agreement"), which every member and visitor must sign before training.
• If these Terms and the Member Agreement ever conflict about your membership, your visits or your use of the gym, the Member Agreement controls.
• Membership pricing, billing, cancellation, freezes and refunds are set out in the Member Agreement and in what you are shown at sign up.
• Day passes are for one visit on the day they are used, are personal to you, and are not refundable once used.
• Submitting a check in or sign up form does not by itself make you a member. Your membership starts once you have signed the Member Agreement and any required payment has been made.

4. Your information

• You agree that the information you give us (name, phone, email, date of birth and similar) is true and belongs to you.
• We collect and use your information as described in our Privacy Policy, posted on our website, and in the privacy section of the Member Agreement. We do not sell your personal information.
• Our forms and messages are run through third party service providers, such as our customer management software and payment processor, which handle your information on our behalf.

5. Text message program

Program name: WNR'S Circle Training Facility texts.

What we send:

• Account and visit messages, such as your waiver link, check in confirmations, membership and billing notices, and facility updates like closures or hour changes. You receive these when you give us your mobile number on our forms.
• Marketing messages, such as offers, events and promotions. You receive these only if you check the marketing consent box on our form.

The details:

• Message frequency varies.
• Message and data rates may apply.
• Reply STOP at any time to stop receiving texts. You will get one message confirming you have been unsubscribed, and no more after that.
• Reply HELP for help, or contact us at (747) 241-8857 or info@wnrscircle.com.
• Consent to receive marketing texts is not a condition of any purchase or membership.
• Carriers are not liable for delayed or undelivered messages.
• We do not share or sell your mobile number or text opt in information with third parties or affiliates for their marketing purposes. Mobile information is shared only with the service providers that help us send messages.

6. Emails

If you opt in to marketing emails, we may send you news, offers and events. You can unsubscribe at any time using the link at the bottom of any email. We may still send emails about your account, membership or billing.

7. Payments

• Payments are processed by a third party payment processor. By paying, you also agree to that processor's terms.
• You authorize us to charge the payment method you provide for any fees you agree to, including recurring membership dues as described in the Member Agreement.
• Prices on our website may change. The price that applies to you is the one shown when you purchase or sign up.

8. Our content

The WNR'S name, logos, photos, videos, website design and written content belong to WNR'S or its licensors. You may view and share our pages for personal use, but you may not copy, sell, or use our name or logos commercially without our written permission.

9. Using the Services

You agree not to:

• submit false information or sign up someone else without their permission
• interfere with, hack, scrape, or overload the website or our forms
• use the Services for anything illegal

We may refuse or end access to the Services for anyone who breaks these Terms.

10. Not medical advice

Any fitness, training or nutrition information on our website or in our messages is general information only. It is not medical advice. Talk to your doctor before starting any exercise program or using the sauna.

11. Third party links

Our Services may link to other websites and apps, such as Instagram, TikTok, Facebook, Google Maps and our payment processor. We do not control them and are not responsible for their content or practices.

12. Disclaimer

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT ALLOWED BY LAW, WE DO NOT PROMISE THAT THE WEBSITE, FORMS OR MESSAGES WILL ALWAYS BE AVAILABLE, ERROR FREE OR SECURE, AND WE DISCLAIM ALL WARRANTIES NOT STATED IN THESE TERMS.

13. Limitation of liability

TO THE FULLEST EXTENT ALLOWED BY LAW, WNR'S AND ITS OWNERS, STAFF AND SERVICE PROVIDERS ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE WEBSITE, FORMS OR MESSAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ABOUT THE WEBSITE, FORMS OR MESSAGES IS LIMITED TO THE AMOUNT YOU PAID US IN THE 3 MONTHS BEFORE THE CLAIM. INJURIES AND YOUR USE OF THE GYM ARE COVERED BY THE MEMBER AGREEMENT, NOT THIS SECTION.

14. Indemnity

You agree to cover WNR'S, its owners and staff for any claims, losses or costs, including reasonable attorney fees, that come from your breaking these Terms or misusing the Services.

15. Disputes

• These Terms are governed by California law.
• If you are a member or have signed the Member Agreement, disputes are handled under its dispute and arbitration section.
• Otherwise, any dispute about the Services will be brought in the state or federal courts in Los Angeles County, California, or in small claims court where it qualifies.
• Before filing any claim, please contact us first so we can try to resolve it.

16. Changes to these Terms

We may update these Terms from time to time. When we do, we will change the effective date at the top. If you keep using the Services after an update, you accept the new Terms. Changes do not apply to a dispute that started before the change.

17. Other terms

• If any part of these Terms is found unenforceable, the rest stays in effect.
• If we do not enforce part of these Terms right away, we can still enforce it later.
• These Terms and the Member Agreement are the full agreement between you and WNR'S about the Services.
